Dennis O’Neil: We Can Be Heroes

In my moment, it’s Labor Day. (In your moment…watch me shrug.) That being so – that Labor Day reality – it seems appropriate to think of unions and a cause dear to my heart.

Unions have not been consistent, not in my limited experience. An anecdote? Right after graduating from college, my friend Don Tonelli and I went to San Francisco. No agenda, just a long ramble to somewhere we’d never been. While in the Bay Area we visited my uncle Oscar, whom I’d seen once very briefly when I was a tot, and who was the subject of a bemused mention at clan gatherings. Oscar was a marvelous old man who kept us entertained and fascinated for most of a week. Among his entertainments were stories of the early days of the unions, when he and other skilled craftsmen went to meetings in large groups, armed with rifles, defying the fat cat bosses and their goons, demanding decent wages and working conditions. Back then, unions were the good guys.

But by the time Don and I shared wonderful hours with Oscar, unions had changed. Not for the better. The story went like this: unions had been infiltrated by criminals and had becomes nests of bullies and mobsters. Pretty damn shady enterprises, all in all. We baby blue staters grouped them with society’s ills. We didn’t consider that they provided insurance plans and pension plans and sundry other benefits, including a sense of the pride in working for a living. We were young. We were slow to look at both ends of a question. And, besides, it felt righteous to be pissed off.

Lately, I’ve grouped unions with the good guys again. They are among the few sources of campaign financing that can compete in fund raising with the billionaire-favored superPACs, and so they help blue collar voices to be heard. And they still provide those benefits. Those benefits are important.

We comics guys have never had unions. The closest thing to a union in our world was the Academy of Comic Book Arts, created by a motley crew of freelancers in 1970. ACBA, as we fondly called it, didn’t attempt to negotiate with the publishers, though that was discussed at early meetings, and in the end, did little to provide those important benefits. What it did do was present yearly awards for exemplary work, and that is no small task. But those awards weren’t of much use if your kid was sick or the rent needed paying.

No unions, no benefits. Good luck.

And this brings us to my heart’s dear cause: The Hero Intiative. Which is what, exactly? Here’s a paragraph from the organization’s website:

The Hero Initiative is the first-ever federally chartered not-for-profit corporation dedicated strictly to helping comic book creators in need. Hero creates a financial safety net for yesterdays’ creators who may need emergency medical aid, financial support for essentials of life, and an avenue back into paying work. It’s a chance for all of us to give back something to the people who have given us so much enjoyment.

If you get a chance to help H.I., you should take it.

Happy Birthday, Jack Kirby! Here’s How To Celebrate!

Today marks the 95th birthday of the all-time king of comics, Jack Kirby. In the comics racket, that makes today a national holiday. The influence of superhero comics on our popular culture has never been greater, and, therefore, Jack’s impact upon our society has never been stronger.

To help celebrate, Jack’s 16 year old granddaughter Jillian has teamed up with our friends at The Hero Initiative on the Kirby4Heroes initiative.

To quote The Hero Initiative press release:

The Hero Initiative, the charitable organization dedicated to helping veteran comic creators in medical or financial need, is celebrating the birthday of Jack “King” Kirby on August 28 with a little help from The King’s family.

Hero has recruited 100 artists to get up on the morning of August 28, 2012 to simply “Wake Up and Draw.” This new event is a way for artists to limber up, get the creative juices flowing, and celebrate the day by drawing and sending a “birthday card to Jack.” All 100 drawings will be featured in a special gallery at ComicArtFans.com, and fans can follow the action through the day on Twitter searching hashtag: #WakeUpAndDraw. All drawings will be auctioned to benefit Hero Initiative at a later date! Neal Kirby, son of Jack, and artist Tim Seeley are featured in a special YouTube video on the event here

And Jillian Kirby, Jack’s granddaughter, has spearheaded the “Kirby4Heroes” campaign. Jillian has recruited a number of comic stores to donate a percentage of their sales to Hero on August 28, and encourage their customers to make donations as well. Fans can donate via the PayPal link at www.HeroInitiative.org, and type in “Kirby4Heroes” in the special instructions box. Jillian has teamed up with Seth Laderman, head of production from the Nerdist Channel, to produce a video spotlighting the campaign. Check out Jillian’s YouTube video on the event here

 “Though my grandfather Jack unfortunately died the year before I was born, I am surrounded by books, artwork, and of course family stories and anecdotes so much that I feel like I’ve known him my whole life,” said Jillian Kirby. “Even though I never had the opportunity to know him personally, I have learned my grandfather was a very giving and charitable man. I know my grandfather would have been the first to lend the Hero Initiative his support.”

Neal Kirby adds, “By supporting the Hero Initiative through the ‘Kirby4Heroes’ campaign and ‘Wake Up and Draw,’ comic book fans can honor my father on his 95th birthday in the same manner that he would have.”

 

Stan Lee’s Poetry – Soon For Posterity!

Way back in the early 1970s, Stan (The Man) Lee wrote… a whole lotta stuff. And among this stuff was a 167-line poem called God Woke.

Now, 40 years later, Stan is going into the studio to record his epic. There’s even better news: the profits will go to The Hero Initiative, a worthy cause if there ever was one.

Stan hasn’t recorded it as of yet, but we’ll keep you informed and advised. God Woke will be available on iTunes, and The Hero Initiative will get 35 cents from each sale.

Which, by the way, is about double cost of a Marvel Comic book around the time Stan wrote the poem.

Robert L. Washington III Laid To Rest

Robert L. Washington III, drawn by Chris IvyThanks to the efforts of the Hero Initiative and comics fans and pros, Robert L. Washington was able to receive a proper funeral.

On Monday, June 25th, a funeral service was held for Robert L. Washington III in the Bronx borough of New York City, with a second service to come in Detroit, Michigan. The service was attended by various comic book creators, classmates, and friends from Robert’s various creative, work, and hobby circles.

Through the actions of Robert’s friends from Milestone Media, Inc. and his classmates from The Roeper School, The Hero Initiative was able to use all of your donations to pay for the service and provide Robert’s mother and two of his sisters with the means to travel from Detroit, Michigan to New York and give him a proper funeral.

Robert L. Washington III: 1964-2012

Robert L. Washington III, drawn by Chris IvyRobert Lee Washington III, a comic book writer best known for writing the first 18 issues of Static for Milestone Media, passed away today after suffering from multiple heart attacks.

Robert had a heart attack yesterday afternoon. He collapsed, unconscious, and was rushed to Mount Sinai hospital in Queens. In the following twenty four hours, he had two additional heart attacks. His heart stopped at 7:18pm tonight and he passed away.

Robert first came to prominence in 1993 writing the debut of Static for the new Milestone Comics line, and later writing Shadow Cabinet. He also wrote Extreme Justice for DC Comics, The Good Guys for Defiant, and Ninjak for Acclaim.

In later years, he’d gone through some rough patches. He’d been homeless a few times, and had received assistance from the Hero Initiative to get back on his feet, but by all accounts was getting back on his feet. He’d even started writing comics again, and his last job was a one page autobiographical story for Hero Comics 2012, a benefit for the Hero Initiative that came out just last month.

His quirky sense of humor made his run on Static a classic. He will be missed.

 

JOHN OSTRANDER: Ghost Rider – What Is Owed?

Denny O’Neil used to have a T-shirt that proclaimed “Growing old is not for sissies.” As I get older, the hard truth of that keeps coming back to me. Case in point.

Two days ago, there was an article here in ComicMix about Gary Friedrich who lost his case against Marvel about participation in the monies made from the movie (now movies) of Ghost Rider, which he created at Marvel. Among other reasons cited by the judge, U.S. District Judge Katherine Forrest, was that Friedrich gave up his rights to the character when he signed checks that had, above the signature line, language requiring him to give up any rights to the character.

I’ve done that, too. You had no choice in the matter in those days. If you wanted to cash the check, you had to endorse it and you had to endorse it beneath the legal crap. There was no negotiation, there was no discussion. It was, to be blunt, coercion.

The name, Ghost Rider, had also already been used at Marvel as one of the Western characters they had – said character, again, being created by Gary Friedrich. Friedrich also had to sign a document giving up all rights – and why wouldn’t he? This was seven years before the first Superman film with Christopher Reeve showed up, six years before George Lucas made Star Wars and showed there was a ton of money to be made off of ancillary rights such as toys et al. You signed those documents because that’s what was necessary to get the work. No movies were being made, no toys were being made, there were no video games – the only money to be made was from the work itself. There was no indie market in those days where you could take your ideas. You made the deal that was there to be made.

The judge had to base her decision on what were the legal facts – and they said that Marvel owed Gary Friedrich nothing. Without Friedrich, however, the property doesn’t exist. From all reports, he’s not in good shape. He could use the money – even a taste.

What is he owed?

Injury to insult department. The judge has not only told Friedrich to stop saying he created Ghost Rider, he was ordered to pay Marvel seventeen grand in damages.

Friedrich owes Marvel $17,000.00!

He’s not the only freelancer in this position. Years ago, I saw Gene Colan and his wife at a convention and I steeled myself up to go say hello to someone I thought (and think) was one of the unique great talents in the industry. He was having eye troubles at the time (with which I would come to completely empathize) and he was, to be honest, a little angry and bitter. Like other old pros, he felt cast aside and forgotten by the industry and he warned me to make sure I had money in the bank or find something else I could do. I wish now I had taken his advice more strongly.

This is not to say there are not groups like the Hero Initiative out there who do tremendous work in helping people who have given to the industry but there are financial limits to what they can do. There is no equivalent to a union or a guild in this industry; if you even think of starting one, you’re gone. John Broome, fabled writer in the Silver Age, found that out.

What is owed to any of those who built a company, built this industry, and then got left behind?

I won’t pretend; I’m more or less in that boat and it scares me. I’m luckier than some; with Amanda Waller, who I created, I’ll see some participation for her use in the Green Lantern movie, just as I did for her use in Smallville and Justice League Unlimited. I think that’s fair and, fortunately, legally binding. Thank you, Paul Levitz.

But what about others, like Gary Friedrich, who worked before there was any such notion? There is, as always, a wide distance between what’s legal and what’s right.

What is owed to those who came before, who did the work on which later, more lucrative, works are built? The contracts, the law, says nothing is owed.

Does that seem right to you?

It doesn’t to me.

If you agree, tell Marvel, tell their parent company, Disney, that they owe the creator something, contract or no contract. Fans can do something and it can be effective. Gary Friedrich isn’t one of the big, great names in comics. But he created Ghost Rider and, legally or not, they owe him.

It’s what’s right.

Ailing Colorist Tom Ziuko Needs Some Help

tz-300x299-4227937Long-time DC Comics and Marvel colorist Tom Ziuko (The History of the DC Universe, Superman, Batman, The Shadow, Hellblazer, Looney Tunes, Spider-Man, Captain America, Tomb of Dracula, etc.) has been facing some difficult medical issues over the last two years, including kidney failure, neuropathy, and, most recently, emergency surgery to repair a strangulated colon.

According to the Facebook page started by Gary Mann for Tom, “Tom is a freelance artist, unable to afford health insurance, and the last year has been brutal for him…. Tom is currently recuperating at home, although still unable to return to work full-time. Early last year, Tom’s friend and fellow freelance artist Alan Kupperberg mounted an effort to help raise some funds for him; and a great non-profit organization, The Hero Initiative, has played a major role in helping Tom to survive during this last year, keeping him afloat and literally saving him from becoming homeless. But Tom continues to face a mountain of medical bills, personal expenses and debt.

“And so I appeal to those of you who may have been touched by Tom’s work over the last three decades; in that you might be able to contribute to assisting him financially while he continues his recovery. I know that times are tight right now for everyone, but any contribution you might be able to make, no matter how small, would be both beneficial and greatly appreciated by Tom.

Jerry Robinson: 1922 – 2011

Comics legend Jerry Robinson died this morning at the age of 89.

Best known for his work with Bob Kane during the earliest days of Batman, the Trenton, New Jersey born artist started off as a teenager lettering and inking the Batman feature in Batman, Detective Comics and World’s Finest Comics. As Batman rapidly grew in popularity, he progressed to the role of character designer and, shortly thereafter, penciler of the feature. It was Robinson who named Dick Grayson “Robin,” not after himself (as often reported) but after N.C. Wyeth’s famed illustrations of Robin Hood. Shortly thereafter, Jerry designed Batman’s most famed enemy, The Joker. His original art for that initial design, in the form of a playing card, has been on display at various museums across the nation.

(It should be noted that the late Bob Kane disputed this and most other creator-credits regarding The Batman. As a matter of contractual obligation, DC Comics gives Kane sole creator credit for the feature, a matter of significant dispute with Robinson as well as writer Bob Finger.)

In later years, Robinson started an international newspaper syndicate (the Cartoonists & Writers Syndicate) and wrote an important history of the comics medium, titled The Comics: An Illustrated History of Comic Strip Art. He also served as president of the National Cartoonists Society in the late 1960s.

His other comic book work included Bat Masterson and Lassie for Dell Comics, Black Terror for Standard Publications, Green Hornet for Harvey, Vigilante and Green Arrow for DC (with his friend and frequent collaborator, Mort Meskin), Green Lama and Atoman for Spark Publications, Journey Into Mystery, Battlefront, Crime Exposed, Strange Tales and Battle Action for Marvel, Rocky and His Fiendish Friends for Gold Key, and Astra for Central Park Media.

Jerry received numerous honors and tributes during his long life, including four separate awards from the National Cartoonists Society: the Comic Book award in 1956, the Newspaper Panel Cartoon in 1963 for Still Life, the Special Features Award in 1965 for Flubs and Fluffs, and the Milton Caniff Lifetime Achievement Award in 2000. He was inducted into the Comic Book Hall of Fame in 2004 and, in 2010, was the recipient of the first annual The Hero Initiative Dick Giordano Humanitarian Award for his “outstanding efforts in changing comics one day at a time.”

The Giordano award focused on Jerry’s less-well known work as a political activist obtaining the release of jailed and tortured cartoonists in Uruguay and the Soviet Union. He also joined Neal Adams and others in the creator rights movement and aided Superman creators Jerry Siegel and Joe Shuster in their struggles with Warner Communications / Time Warner in obtaining recognition and financial security for their efforts.

[[[Jerry Robinson: Ambassador to the Comics]]], the definitive history of this critically significant cartoonist, was published by Abrams late year.

On a personal note, I had the honor and privilege of dining with Jerry and discussing both politics and comics on numerous occasions during the 1970s, 80s and 90s. When, last year, we met up at the Baltimore Comic-Con at the reception prior to his Giordano Award presentation, I found Jerry to be as gracious, as warm and as sharp as he had ever been, and he entertained my daughter with stories peppered with quotes from material I had written about him many, many years earlier.

It was one of the most wonderful moments of my life.

Mike Gold gets Dick Giordano Humanitarian Of The Year Award from HERO Initiative

We are exceptionally proud to note that our own Mike Gold, Editor in Chief of ComicMix, was given the first Dick Giordano Humanitarian Of The Year Award from the HERO Initiative at this year’s Harvey Awards ceremony at the Baltimore Comic-Con. The award was presented by Mark Wheatley.

While note was made of Mike’s long career and assistance to various creators and causes, and the publishing of Dick Giordano’s last major comics work, White Viper, he was singled out this year for the efforts in raising money to save comics writer John Ostrander‘s eyesight.

In his acceptance speech, Mike thanked Gail Simone and Adriane Nash, who worked with him on fundraising.

Mike is a 30-year veteran of the comics industry, having served as group editor and director of editorial development for DC Comics, founder and editorial director of First Comics Inc., and publisher of Classics Illustrated. Prior to ComicMix, Gold had been editorial director for ArrogantMGMS, creating intellectual properties and overseeing media and ancillary rights and packaging comic books published by numerous comic book imprints, including Image, Acclaim and IDW.

He was a pioneer in the creation of an American market for graphic novels, and edited more than three-dozen graphic novels and anthologies, including the bestsellers The Greatest Batman Stories Ever Told, Green Arrow: The Longbow Hunters, The Joker: Stacked Deck, GrimJack: Killer Instinct, Jon Sable Freelance: Bloodtrail and American Flagg!.

In addition, Mike has an extensive background in the media and in the youth social services field, having been a broadcaster and radio personality, director of communication and education for a major Chicago drug abuse prevention program, cofounder and director of communication of the National Runaway Switchboard, and creator, and managing editor of Video Action magazine.

He has been an author and editor of, or contributor to, more than one dozen books, including, as Mark was quick to point out, [[[How To Draw Those Bodacious Bad Babes of Comics]]] with artist Frank McLaughlin. His work has appeared a wide range of newspapers and magazines, including The Chicago Tribune, The Realist and the British edition of MacUser magazine.

He has also served as a consultant to the Organic Theater of Chicago (home to Dennis Franz, Joe Mantegna, Ray Bradbury and David Mamet), the Stratford Connecticut Shakespeare Festival Theater, to numerous political efforts, and to The Child Care Center of Stamford, an award-winning Head Start and early childhood education program, as well as a media coordinator for the Chicago Conspiracy Trial.

Mike has received numerous awards previously, including the prestigious Comics Buyers’ Guide Award as favorite editor and the Golden Apple Award for best comics limited series (Green Arrow: The Longbow Hunters).

Announcing The Rob Granito ‘Put Up Or Shut Up’ Fund

Last week, an email was sent around to various comic news sites saying that we could interview Rob Granito, the self-styled “bad boy of comics” for the princely sum of $250/hour so that we could get his side of the story. Rob, as you’ve probably heard by now, was going around to various conventions and selling artwork that he plagiarized from everybody from Andy Kubert to Bill Watterson, and claimed working with numerous people in the industry, many of whom are deceased, including the recently departed Dwayne McDuffie.

Now normally, someone who’s been accused of plagiarism and theft would be happy to talk to news outlets for free in the hopes of getting his side of the story out there so that he would stop being reviled and might actually get back into a comic convention or two, but not Mr. Granito.

But if that’s the way he wants it, fine. $250 it is.

Here are our terms, Rob:

We will pay your $250/hour rate for a video interview on Skype. At the beginning of that hour, we will provide you with the name of a comic character and a celebrity, and we will ask you to draw the character with that person’s head performing a simple action on camera. It could be Superman with Barack Obama’s head throwing a ball, or Wonder Woman with Jane Lynch’s head skipping rope, or Patrick Dempsey as Dr. Strange.

Any professional comic artist can create a sketch like this in a half hour, but we’ll give you the full hour. Of course, you can take longer than an hour, though we will only pay you for the first hour and we will ask you to keep the camera rolling, as we will be placing the video online so anyone can see your artistic process. We’ll also ask for a picture of the final art if your webcam resolution isn’t good enough to show the quality of your work.

And obviously, if we find evidence that you swiped the work, you won’t see a dime.

As to the rest of the comics community, we’d like to ask you to contribute to the fund to show your support. All funds raised above and beyond the cost of the “interview” (or all of it should Rob decline our offer) will be donated to the Hero Initiative, a not-for-profit organization dedicated to helping comic book veterans by providing a financial safety net for comic creators who may need emergency medical aid, financial support for essentials of life, and an avenue back into paying work. We’ll include your name as contributors to the fund both here on ComicMix and at the end of the video. While waiting for Kickstarter to kick in, here’s the PayPal donation button:





We’ll be updating contributions from time to time. We hope that you’ll contribute. Heck, we also hope that Rob contributes his fee and his drawing to Hero Initiative, though we aren’t expecting him to do so.
